Terms and Conditions of Sale

Summary
These terms govern the purchase and use of Bandeo Studio credits to access AI-assisted comic generation features.
1. Publisher identification
These Terms and Conditions of Sale are entered into between Bandeo Studio, a digital service operated by its publisher and reachable at support@bandeostudio.app, hereafter the Publisher, and any person using Bandeo Studio, hereafter the User or Customer.
The publisher's complete administrative information must be kept up to date in the legal notice before large-scale commercial operation.
2. Purpose
Bandeo Studio provides a digital AI-assisted creation service used to generate comic-related content from instructions supplied by the User.
3. Acceptance of terms
Any credit order implies full acceptance of these terms. The User must be able to review the terms before purchase and may be asked to confirm acceptance before payment redirection.
4. Service description
The service allows users to create comic projects, generate text, prompts, images, Markdown and PDF files, browse archives, optionally send PDFs by email and manage credits.
Generated results may vary depending on the quality of instructions, the AI models used and the technical constraints of the service.
5. Account creation
Access to the service may require a user account. The User is responsible for the accuracy of the information provided and for keeping credentials confidential.
6. Credits
Credits are an internal usage unit used to access generation features. They are not electronic money, cannot be converted into cash and cannot be resold or transferred unless expressly agreed by the Publisher.
7. Credit purchases
The User may purchase credit packs. Each pack states the number of credits and applicable price. Credits are added to the account after payment confirmation. When Stripe is used, payment is processed by Stripe. Bandeo Studio does not store full card details.
8. Prices
Prices are displayed in the currency shown on the site and may be changed at any time. The applicable price is the price displayed at the time of order. VAT is applied according to applicable rules.
9. Payment terms
Payment is made online by card or by any method offered through Stripe. The order is confirmed after payment validation. If payment is refused, credits are not granted.
10. Credit use and consumption
Before a generation, the application may display an estimate or credit cost. This cost may depend on the number of pages, generation mode, Express Page, quality options, future retouching or future PDF rebuilds.
In case of a technical failure attributable to the service, credits may be restored according to internal rules.
11. Gift codes and offered credits
Gift codes or offered credits may be provided. They may be time-limited, reserved for a user or subject to conditions. They have no refundable monetary value.
12. Digital service delivery
Credits are delivered to the user account after payment confirmation. Generated content is made available in the user workspace, including completed projects or archives.
13. Right of withdrawal
Under rules applicable to distance contracts, consumers generally have 14 days to exercise their right of withdrawal.
When the User requests immediate execution of a generation before the end of any legal withdrawal period, consumed credits for a fully performed digital service may no longer be eligible for withdrawal, subject to mandatory consumer law.
Unused credits remain handled according to the refund or credit-note conditions communicated by the Publisher.
14. Refunds
Purchased and unused credits may be subject to applicable withdrawal rules. Credits consumed for a completed generation are generally non-refundable, except in case of a proven service malfunction or contrary legal obligation.
15. User obligations
The User agrees not to use the service to generate unlawful, defamatory, infringing, hateful, violent, discriminatory or third-party rights-infringing content.
16. AI-generated content
Generated content may contain errors, inconsistencies or unexpected elements. The User must review content before publication or commercial use.
17. Intellectual property
The application, interface, brand, code, text and graphic elements remain the property of the Publisher or its rights holders.
Subject to third-party provider rights and the User's own rights over source instructions and materials, the User may use generated content for personal or professional purposes.
The User remains responsible for checking that source content, references and publications do not infringe third-party rights before distribution.
18. Third-party services
The service may rely on third-party providers, including Stripe for payment, AI model providers, hosting, email and storage services.
19. Service availability
The Publisher makes efforts to provide access to the service but does not guarantee permanent availability. Interruptions may occur for maintenance, outage, overload or technical intervention.
20. Liability
The Publisher cannot be held liable for improper use of the service, user-provided content, decisions made from generated content, third-party interruptions or indirect losses, subject to mandatory applicable provisions.
21. Personal data
Personal data is processed in accordance with the Privacy Policy available from Bandeo Studio.
22. Claims and support
For any question, claim or order-related request, the User may contact support@bandeostudio.app and provide the account email, purchase date, Stripe reference if available and a description of the issue.
23. Consumer mediation
If no mediator is designated in the publisher's legal information, the User should contact support to obtain applicable mediation details before starting any formal process.
24. Governing law and jurisdiction
These terms are governed by French law, except where mandatory consumer provisions provide otherwise.
25. Changes to terms
The Publisher may modify these terms. The applicable version is the version in force on the order date.
